Signed, sealed, delivered: the growth of the Pre Nuptial Agreement
Recent headlines suggest there is a boom in couples securing Pre Nuptial Agreements, with a reported one in five couples seeking to draw up an agreement, according to figures from The Marriage Foundation.
Partner Scott Halliday, who is head of the Family team at Sintons, says the picture of more couples obtaining pre nups is being reflected in the work he and his team undertake for clients across the UK.
“We are regularly instructed nationwide on a range of Pre and Post Nuptial Agreements, they are now absolutely at the front of people’s minds as they approach marriage, or within a marriage.”
Scott adds, “The skill with a Pre Nuptial Agreement is to advise and consider reasonable provision effectively, so that both parties can proceed smoothly and know the agreement is fair and detailed, to maximise its utility if ever required amidst a separation.”
While it’s often assumed pre and post nups are solely the preserve of the very wealthy or something celebrities and elite athletes require, Scott explains that pre nuptial agreements have their place for many other clients, too.
“These sorts of documents are still commonplace for high-net-worth individuals, be it with monies generated from professional life, business interests and/or intergenerational wealth. But they are also of huge value in single issue cases, around large deposits for property and or those contemplating a second marriage and wishing for some form of security in advance.”
